Terms of Service

1. Agreement

By creating a Watinza account, you agree to be bound by these Terms of Service ("Terms"). If you are using Watinza on behalf of a business, you confirm you have authority to bind that business to these Terms.

2. The service

Watinza is a software platform that connects to your own WhatsApp Business Account on the Meta Cloud API and lets you manage contacts, templates, and template-based campaigns. Watinza does not provide the underlying WhatsApp messaging — that is provided by Meta under their own terms.

3. Your responsibilities

• You must comply with Meta's WhatsApp Business Messaging Policy and Commerce Policy at all times.
• You may only message end-customers from whom you have collected explicit opt-in consent, in line with applicable law in their jurisdiction.
• You must not send spam, scams, illegal content, or anything that violates WhatsApp's terms.
• You are responsible for the content of every message sent through your workspace.
• You must respect opt-out requests immediately. Watinza auto-detects STOP keywords but you must also honor any other request to stop messaging.

4. Meta credentials

You authorize Watinza to use the WhatsApp Business credentials you connect (via Embedded Signup or manual configuration) solely to operate the platform on your behalf. You may revoke this authorization at any time by disconnecting your account or removing the System User token from Meta Business Manager.

5. Account suspension

We may suspend or terminate your account if we believe you have violated these Terms, Meta's policies, or applicable law. We will provide notice and, where possible, an opportunity to remedy the violation.

6. Fees

Subscription fees, if any, are set out on our pricing page. WhatsApp conversation charges are billed by Meta directly and are not included in Watinza's fees.

7. Disclaimers

Watinza is provided "as is" without warranties of any kind. We do not guarantee delivery of any specific message — final delivery depends on Meta, the recipient device, and network conditions. We do not warrant that the service will be uninterrupted or error-free.

8. Limitation of liability

To the maximum extent permitted by law, Watinza's aggregate liability is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for any indirect, incidental, consequential, or punitive damages.

9. Indemnification

You agree to indemnify Watinza against any claim arising out of (a) your use of the service, (b) the content of your messages, (c) your violation of these Terms, or (d) your violation of any law or third-party right (including Meta's policies).

10. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Sheridan County, Wyoming.

11. Changes

We may update these Terms from time to time. Material changes will be announced inside the dashboard at least 30 days before they take effect. Continued use after a change constitutes acceptance.
